A Study on the Causes of and Countermeasures Against Domestic Violence

본 논문에서는 배우자 폭력의 발생 원인을 중점적으로 살펴보고, 이에 대한 대응 모델들을 정리했다. 그리고 비교적 성공적인 제도로 평가되고 있는 영국의 시스템을 소개하고 시사점을 도출함으로써 궁극적으로 국내 도입 가능성을 살펴보았다. 본 연구는 문헌연구와 현장조사를 병행하여 진행되었다. 먼저 문헌조사와 설문조사에서는 각각 배우자 폭력의 원인은 매우 다양하고 이 문제에 적절하게 대응하기 위해서는 사회복지와 사회심리 및 형사정책 등 다양한 관점에서 포괄적 논의가 요청된다는 점을 확인할 수 있었다. 다음으로 우리나라의 배우자 폭력 대응체계는 주로 형사적 대응 모델과 행정적 지원 모델을 병행하고 부수적으로 민사적 대응 모델을 채택하고 있는 것으로 보인다. 피상적으로는 각 모델의 장점들을 활용할 수 있을 것처럼 보이지만 실질적으로는 재범방지와 피해자 보호라는 양대 정책목표를 달성하기 매우 어려운 구조를 지니고 있다. 영국의 배우자 폭력 대응체계는 우리에게 적지 않은 시사점을 제시하고 있다. 구체적으로 언급하면, 영국에서는 첫째, 경찰이 배우자 폭력 가해자에게 보호통지를 발령하고 법원에 신속하게 보호명령을 청구함으로써 피해자 보호에 만전(萬全)을 기하고 있고, 둘째, 배우자 폭력 정보공개 청구제도를 통해서 파트너의 배우자 폭력 전력을 확인할 수 있는 기회를 제공하고 이를 통해 범죄예방에 기여할 수 있으며, 셋째, 가정폭력 전문법원제도를 채택함으로써 피해자 보호 및 가해자 처우에 전문성을 확보하고, 넷째, MARAC제도를 통해서 관련 기관간의 협업(cooperation)을 강화하고 이를 토대로 배우자 폭력을 통해서 유발될 수 있는 위험성을 최소화하고 있다. 궁극적으로는 영국의 가정폭력보호통지 등과 같은 선진적 제도들의 장단점을 체계적으로 살펴보고 국내 도입을 적극적으로 검토할 필요성이 크다고 생각된다.The purpose of this research is to investigate the causes of and countermeasures against domestic violence. Generally speaking, the causes of domestic violence are as fellows: social and demographic characteristics, patriarchal ideology, poverty, alcoholism, relationship conflict, social norms and so on. In Korea, the protection victims from domestic violence is covered by two special acts. The one is Act on Special Cases Concerning the Punishment, Ect. of Crimes of Domestic Violence, the other is Act on the Prevention of Domestic Violence and Protection, Ect. of Victims. The Punishment of Domestic Violence Act regulates emergency measures concerning crimes of domestic violence, ad hoc measures, urgent ad hoc measures, and so on. And the Prevention of Domestic Violence Act regulates that the State and a local government shall take measures to prevent domestic violence and to protect and support victims. But I think that the judicial systems in Korea have failed to control domestic violence effectively. I also conclude that the reasons of this failure lies on laws related to domestic violence. The following items can be suggested as solutions and alternatives for the issues. First, it is necessary to do benchmarking Domestic Violence Protection Notices and Domestic Violence Protection Orders with which a suspect can be prohibited from returning to a residence and from getting contact with the victim. Second, it is needed to introduce the domestic violence disclosure scheme with which an individual can ask police officers to find out whether a new or existing partner has a violent past and an agency is able to apply for a disclosure if the agency believes that an individual is at risk of domestic violence from his or her partner. Third, it is need to do benchmarking MARAC(Multi Agency Risk Assessment Conference) in U.K. Fourth, it also necessary to consider introduction of specialist domestic violence court system.
